Terms of Service
The rules for using VERSUS.
1. Who we are
VERSUS is operated by PROJECT_NAME Holdings LLC ("we", "us"). VERSUS is an entertainment platform where people pick a side in a public battle between two competitors.
2. Eligibility
You must be at least 13 years old to use the platform, and at least 18 to purchase anything. If you are under the age of majority where you live, you may only purchase with a parent or guardian's consent.
3. Your account and anonymous participation
You can browse and support battles without an account. We issue every visitor a signed anonymous device identity so we can enforce the one-free-support-per-battle rule. You are responsible for activity from your device and account.
Creating multiple identities to support the same battle more than once is a breach of these terms and may result in removal of the affected support and suspension.
4. Paid support power
Power packs buy support power and status inside a battle. They are not a wager, entry, contest fee, investment, security, sweepstakes entry, or lottery ticket. They have no cash value, cannot be exchanged, transferred or withdrawn, and pay out nothing under any outcome.
There is a per-person spending cap on every consumer battle. We may lower or raise this cap. See the Paid Boost Rules for details.
5. Content you create
You are responsible for battles you create. You must not create content that harasses, targets a private individual, incites hate, impersonates someone, is sexual or illegal, or promotes self-harm or dangerous acts. See the Community Guidelines.
You grant us a non-exclusive, worldwide, royalty-free licence to host, display and distribute the content you submit, for the purpose of operating and promoting the platform.
6. Third-party names and marks
VERSUS is an independent platform and is not affiliated with, sponsored by, or endorsed by any entity appearing in user-created battles unless explicitly stated.
Rights holders can request removal via our Trademark / DMCA process.
7. Fair play and integrity
All scoring is server-side and auditable. Automated voting, vote farms, referral farming, payment fraud and scraping at volume are prohibited. We may void support, reverse referral rewards, suspend accounts, and cancel battles that were manipulated.
8. Availability and changes
The service is provided as-is. We may change, pause or discontinue features, including cancelling a battle for safety, legal or integrity reasons.
9. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
Battles are opinion contests run for entertainment. Results are not statements of fact about any person, product or business, are not surveys, and are not represented as statistically valid.
10. Limitation of liability
To the maximum extent permitted by law, neither we nor our suppliers are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or goodwill.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the preceding twelve months, or USD 50.
Some jurisdictions do not allow certain exclusions or limitations. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing here limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of content you create, your breach of these terms, or your violation of anyone else’s rights. We may assume the defence of any such claim at our expense, and you agree to cooperate.
12. Termination
You may stop using the service and delete your account at any time from your profile page.
We may suspend or terminate access for breach of these terms, for manipulation of results, for payment fraud, or where required by law. Where practical we will tell you why and give you a way to appeal. Sections that by their nature should survive termination do survive it.
13. Changes to these terms
We may update these terms. For material changes we will give at least 30 days’ notice in the product or by email before they take effect, and the date of the current version is shown at the top of this page. Continuing to use the service after that date means you accept the new terms; if you do not, stop using the service and you may request a refund of any unused paid support.
14. Governing law and disputes
These terms are governed by the laws of Delaware, USA, without regard to conflict-of-law rules.
PLEASE READ THIS PARAGRAPH CAREFULLY. Except for small-claims matters and requests for injunctive relief about intellectual property, you and we agree to resolve disputes by binding individual arbitration rather than in court, and to waive any right to a jury trial and to participate in a class, collective or representative action.
You may opt out of arbitration by emailing support@example.com within 30 days of first accepting these terms, stating your name and that you opt out. Opting out does not affect any other part of these terms.
Nothing in this section removes any right you have under mandatory consumer-protection law in your country of residence, including the right to bring proceedings in your local courts.
15. General
These terms, together with the Privacy Policy, Community Guidelines and Paid Boost Rules, are the entire agreement between us. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them as part of a merger, acquisition or sale of assets.
You may not use the service if you are subject to sanctions or located in an embargoed territory, and you may not use it in violation of export-control laws.
